Abstract

The Raperda on Zakat Management has been jointly approved by the DPRD and the Banyumas Regent, but the results of the facilitation by the Governor of Java However, the results of facilitation for the submission of the Raperda on zakat management in Banyumas Regency need to be reviewed. The aims of this study are: 1) To analyze what factors caused the Governor of Central Java to stipulate the Draft Regional Regulation on Zakat Management to be reviewed to become a Regional Regulation. 2) To analyze the material contained in the Draft Regional Regulation on Zakat Management in Banyumas Regency which, according to the Governor of Central Java, is being reviewed for compliance with Article 10 of Law Number 23 of 2014 concerning Regional Government. 3) To analyze the maqãshid sharia review of the Central Java governor's letter regarding the Draft Banyumas Regency Regional Regulation relating to Zakat Management. The research approach used in this study is an empirical juridical approach to the type of library research. The research was conducted in Banyumas Regency from January to July 2022. The research subjects were officials at the Banyumas Regency Government, the Banyumas Regency DPRD and the Legal Bureau of Central Java Province as interested parties in the preparation of the Raperda on Zakat Management. The object of research is secondary data analysis of regional urgency and authority in drafting the Raperda on Zakat Management contained in laws and regulations. Observation data collection techniques, interviews and documentation. Data analysis techniques using qualitative analysis. The results of the study show that: 1) The factors that caused the Draft Regional Regulation on Zakat Management to be reviewed to be enacted as a Regional Regulation are because zakat is a religious matter which is the authority of the central government. 2) After reviewing the draft Perda material, there is no content that regulates regional government affairs. 3) Study of maqãshid sharia from the facilitation results of the Governor, the regulation of zakat will be better regulated by law than by regional regulation.
