Abstract

The designers of the 1945 Constitution of the Republic of Indonesia think believe that a presidential government system has an unstable and ineffective system. Since the 4th Amendment to the 1945 Constitution of the Republic of Indonesia NRI the prevailing presidential system has been accompanied by a check and balance system. With the President’s presidential being adopted as head of state and head of government. The president appoints and dismisses state ministers. The state ministers are responsible to the President. The party system adopted is multi-party, but this a presidential system that is considered to threaten stability. The ability to control multiple parties is important key to creating government stability. The presidential cabinet in Indonesia be composed of a President is assist by vice-president and ministers and ministerial-level officials. To be appointed as a minister one has the technical and professional qualifications to carry out government duties. Research conducted by researchers includes library research which aims to collect data and information sourced from library data, such as books, books, and articles. The research approach used is normative juridical, law in the form of a statutory approach. The data collection method used is documentation. The primary data source used is the work of Imam al-Mawardi the book al-Ah{ka>m al-Sult}aniyah, specifically regarding the criteria of the minister as an assistant Khalifah (wilayah al-wizarah) and Law Number 39 the Year 2008 concerning State Ministries. This research shows that ministries in Indonesia apply the concept of al-wizarah Imam al-Mawardi theory substantively, this requires conceptual approval in the appointment of ministers as needed and experts in their tasks. However, the adoption of multi-party political parties also influenced the appointment of ministers by the President.
