Abstract

Dalam dunia bisnis, kontrak sangat banyak digunakan orang bahkan hampir semua kegiatan bisnis diawali oleh adanya kontrak. Begitupun bisnis perbankan syariah yang sangat ini berkembang pesat. Dalam hal ini, perusahaan atau perbankan dituntut untuk melakukan kontrak dengan seefisien mungkin. Padahal pejanjian merupakan ruh dari setiap bisnis yang dilakukan. Banyak perusahaan yang menggunakan perjanjian baku dimana perjanjian baku merupakan perjanjian yang telah disediakan oleh pihak perusahaan. Namun demikian, dalam perjanjian baku konsumen atau nasabah tidak memiliki negosiasi untuk menentukan perjanjian pada saat transaksi, sehingga hal ini terkadang melanggar salah satu asas perjanjian, yaitu asas kebebasan berkontrak. Begitupun pada BPRS Bina Amanah Satria Purwokerto yang juga menggunakan draft perjanjian baku dalam penyusunan perjanjian pembiayaan murabahah. Dengan kata lain pihak bank telah sebagian besar menentukan isi perjanjian murabahah tersebut. Hal ini menjadikan pihak nasabahhanya dapat menentukan klausal-klausal tertentu saja. Sehingga dapat dikatakan bahwa asas kebebasan berkontrak belum sepenuhnya diterapkan pada perjanjian pembiayaan murabahah di BPRS Bina Amanah Satria Purwokerto. Penelitian ini merupakan penelitian lapangan (field research) dengan menggunakan metode kualitatif dengan analisis deskriptif. Kemudian objek penelitian ini yaitu Penerapan Asas Kebebasan Berkontrak. Disini peneliti terjun langsung kelapangan untuk mendapatkan data melalui observasi, wawancara, dan dokumentasi untuk mengetahui bagaimana asas kebebasan berkontrak diterapkan pada perjanjian pembiayaan murabahah di BPRS Bina Amanah Satria Purwokerto. Hasil dari penelitian ini adalah bahwa asas kebebasan berkontrak diterapkan dengan baik pada perjanjian pembiayaan murabahah dengan adanya proses negosiasi diawal sebelum kesepakatan terjadi antara pihak nasabah dengan pihak bank. Selain itu, bukan berarti asas kebebasan berkontrak itu bebas dalam segala hal akan tetapi ada limitasi dalam asas kebebasan berkontrak ini. Sehingga setiap perjanjian harus memberikan manfaat dan kemaslahatan kepada kedua belah pihak. Asas kebebasan berkontrak dalam perjanjian pembiyaan murabahah pada dasarnya sama dengan asas pada perjanjian konvensional yaitu dengan asas itikad baik, kepatutan dan keadilan sehingga terwujud mitra janji yang terbina dengan baik yang tidak bertentangan dengan undang-undang. Likewise this very sharia banking business is growing rapidly. In this case, the company or banking is required to contract as efficiently as possible. Even though the agreement is the spirit of every business done. Many companies use standard agreements where the standard agreement is an agreement that has been provided by the company. However, in the standard agreement consumers or customers do not have negotiations to determine the agreement at the time of the transaction, so this sometimes violates one of the principles of the agreement, namely the principle of freedom of contract. Likewise for BPRS BinaAmanahSatriaPurwokerto who also used the draft standard agreement in the preparation of murabahah financing agreements. In other words, the bank has largely determined the contents of the murabahah agreement. this makes the customer only able to determine certain clauses. So that it can be said that the principle of freedom of contract has not been fully implemented in the murabahah financing agreement at the BPRS Bina AmanahSatriaPurwokerto. This research is a field research (field research) using qualitative methods with descriptive analysis. Then the object of this research is the Application of the Contracting Freedom Principle. Here the researchers go directly to the field to obtain data through observation, interviews, and documentation to find out how the principle of freedom of contract is applied to the murabahah financing agreement in the BPRS Bina AmanahSatriaPurwokerto. The results of this study are that the principle of freedom of contract is applied well to murabahah financing agreements with the negotiation process in place before the agreement takes place between the customer and the bank. Besides that, it does not mean that the principle of freedom of contract is free in all respects but there are limitations in this principle of freedom of contract. So that each agreement must provide benefits and benefits to both parties. The principle of freedom of contract in the agreement on financing murabahah is basically the same as the principle of conventional agreement, namely with the principle of good faith, decency and justice so that a promising partner that is well-established can not materialize against the law.
