Abstract

Marriage is an inner birth bond between a man and a woman as husband and wife with the aim of forming a family (household) a happy and eternal family based on the One True Godhead. Thus reads article 1 of 1974 concerning Marriage. Human rights are fundamental rights and freedoms for all people, regardless of nationality, gender, national or ethnic origin, race, religion, language, or other status. Human rights include civil and political rights, such as the right to life, freedom and freedom of expression. In addition, there are also social, cultural and economic rights, including the right to participate in culture, the right to food, the right to work and the right to education. This research is a library research, which is a research activity obtained from books that are indirectly related to and support the object of this research. In this study, the authors used data collection methods and documentation techniques. After obtaining the necessary data, then the data is analyzed by the method of comparative analysis. The results of this discussion show that there are differences in marriage law between Islamic Law and Human Rights. Where based on Islamic Law interfaith marriage is clearly prohibited but according to Human Rights, interfaith marriage is legal.
